Menifee Girls Softball President – Jennifer Martinez and the MSG Board – Censor a MSG 8u Manager – Selectively Punish Him in Violation of Their Own Rules While Protecting Fellow Board Members Who Violated Code of Conduct – Appeal Met with Corruption

A United States Department of Justice ADA Complaint was filed against Menifee Girls Softball, ASA Softball and USA Softball, alleging willful discrimination and retaliation against 8 year old Type 1 Diabetic Menifee Girls Softball Player – Gracie Sevilla and her parents.

Gracie Sevilla, age 8, is a Type 1 Diabetic Athlete who suffered total pancreatic failure at age 4 and is Insulin dependent, requiring multiple daily injections of Insulin to metabolize the carbohydrates she eats in her meals and snacks throughout the day; in a healthy individual, this is the job of the functioning Pancreas. Gracie also wears a Dexcom Continuous Glucose Monitoring System; a small device with a filament that inserts below the skin and continuously tests the interstitial fluid for accurate Glucose levels, then brings the reading back to her parents’ mobile device every 5 minutes. The Dexcom alerts both high and low Glucose levels for immediate treatment decisions.

Gracie has endured Blood Glucose Levels as high as 600 + and as low as 24. Both exceedingly high or low levels, such as these, can result in Diabetic Coma or Ketoacidosis, both of which can be fatal in a short matter of time.

Gracie’s father, Tommy Sevilla, was Manager of Menifee Girls Softball (MSG https://www.menifeegirlssoftball.com) 8u 3-0 Florida Gators team and was one of 5 different Managers that were ejected by overzealous umpires on one day and weekend; Sevilla pointed out an illegal Coach Pitching motion that allowed for the opposing player to easily hit the ball and score runs, in violation of MSG Rules but was rebuffed by the Umpire – who arrived to the game in a foul mood 25 minutes after it had started. According to MSG rules, a Manager who is ejected during a game, must also serve an additional game suspension and must immediately leave the premises – not owned by MSG – and cannot be physically present for the next game. However, in retaliation for his free speech and non-threatening comments about overzealous umpires on the MSG Coaches Social Media Thread, Coach Sevilla was censored, as Board Member at Large, Alysa Mugica, her husband and others; including MSG Board Vice-President, David Miller – openly disparaged him on the thread, both before and after he was censored, and while Board President, Jennifer Martinez did nothing but allow the open disparagement; thus violating MSG’s Social Media Policy and Code of Conduct; they were not punished in any form but within minutes of censoring Sevilla on the thread, a vote was taken by the MSG Board to remove him as Manager of the team and thus also nullifying the requirement for him to have to serve the additional game suspension as Manager.

Coach Sevilla appealed their game loss officially, on the grounds that the opposing team won the game due to runs scored with an illegal soft toss underhand pitching motion by the opposing coach that was recorded on video, as well as the game not being a “regulation game” since the game started almost 20 minutes late on account of the Umpire showing up late and the game having to be started by a Board Member acting as an Umpire. However, the MSG Board would attempt to delay and suppress the Appeal by first demanding a $35 fee to hear the Appeal then fail to provide a method or mode of payment for the Appeal when Coach Sevilla was diligent in trying to pay the fee then, not showing up to the designated meeting place (practice field) to pick up Coach Sevilla’s payment. Official witnesses and evidence provided by Sevilla for his Appeal was not considered, in violation of League Appeals Policy and without notice and unbeknownst to Coach Sevilla, the Appeal was heard illegitimately, falsely and corruptly; claiming video evidence not supplied by Coach Sevilla – with no witness testimony and Sevilla not present or being invited to attend; the Board would lie and falsely claim that the opposing Coach pitched in a League approved pitching motion and essentially that the game started on time, despite abundant evidence to the contrary.

Gracie Sevilla subsequently, was not allowed to play in the next game because despite being warned of a potential ADA violation (Americans with Disabilities Act Title II Regulations; Part 35 – non-Discrimination on the Basis of Disabilities, et. al….), because her mother, Melodie Sevilla couldn’t attend the game and her father, who is trained to be able to manage her Diabetes, was banned from the game now as her parent, due to the unprofessionalism, spite and retaliation from MSG Board President, Jennifer Martinez and fellow Board Members: David Miller, Vice-President, Steven Cordova, Coaches Agent, Rachelle Wade, Player Agent, Lindsey Duffy, Treasurer, Ashley Vidal, Secretary, Kyle Titterness, UIC and others. Ultimately, Board President, Jennifer Martinez refused to make a reasonable accommodation for Gracie to play in the game and scoffed at the requirement of law and remained deliberately indifferent to Gracie’s qualifying disability, bent on punishing her father as a parent. Jennifer Martinez would threaten to call law enforcement if Gracie’s father, the censored Coach were to show up but backed off that threat when she was appraised of the fact that she had no authority to do so on private property not owned by but only used buy the league; Marion Ashley Park is a public facility. However, Martinez would then threaten to punish the entire Gators’ team of 8 year old girls with a “forfeit” if their Coach – Sevilla – were to be at the game to watch the team and his daughter play and also be there to treat her Diabetes so that she could play in the game.

Gracie’s mother, Melodie Sevilla, would reach out to Martinez then the USA Softball Board of Directors; including but not limited to: State Commissioner, Christina Drumm, President, Mike Schuck, who never responded to calls and emails and when she reached out to Rhonda Shirey, the Eastern District Commissioner, she was again met with deliberate indifference as Shirey promised to intervene and get back to Mrs. Sevilla by days end, she never did and ignored all follow up urgent phone calls and voicemails left and emails sent to her by Mrs. Sevilla.

Menifee Girls Softball Board President, would openly scoff at the issue, make no effort to provide a reasonable accommodation in accordance with Federal Law, focus on Coach Sevilla now being punished as a Parent, while no longer a Manager of a Team, and ultimately causing tremendous undue stress and trauma upon Gracie and her family, as well as the team itself, who now lost their Manager, faced forfeit scenarios and a season ruined by Menifee Girls Softball Board of Directors politics.

Gracie Sevilla was deprived of the opportunity to play in the game in question and subsequently, several additional games due to this controversy and the deliberate indifference and attitude toward her disability by the MSG board of Directors, ASA Softball and USA Softball, who refuse to intervene and honor the American with Disabilities Act.

On June 8, 2021, a Complaint was filed with the Department of Justice alleging that Jennifer Martinez, et al, the MSG Board, USA softball and ASA Softball, have willfully discriminated and retaliated against 8u girls softball player – Gracie Sevilla and her family.

Gracie Sevilla is a Folkstyle Youth Wrestling Champion for Team So. Cal of Temecula, winning her first two tournaments in Bakersfield, California and Phoenix, Arizona, even being awarded the “Most Outstanding Wrestler Award” as an athlete new to the sport of competitive wrestling. Gracie also excels in Gymnastics, Basketball, Soccer; she was the quarterback on her fathers Friday Night Lights Football team;  and is a Pitcher on her Menifee 8u Girls Softball team, recording 8 strikeouts against 9 batters faced in her first ever game as Pitcher.

Washington, D.C. – July 17, 2019 –National Indian Gaming Association Chairman Ernie Stevens, Jr., issued the following statement after the passage of House Resolution 489, regarding President Trump’s divisive comments directed at Members of Congress.
“The National Indian Gaming Association denounces the comments directed towards respected female Members of Congress. They are American citizens, duly elected by their fellow citizens, and they deserve better treatment from the Office of the President. Coming off of a historic election where the first two female Native Americans were elected to the Congress, we should be honoring the strength of this Country represented by one of the most diverse Congress’ in this Nation’s history.
The idea of America would not have been possible if it weren’t for the fact that Native Nations welcomed the first European settlers fleeing their home countries for a better life. The original sin of slavery and hatred directed at groups of immigrants stunted our growth.
For Indian Country, the violation of treaties, theft of lands, and devastating genocide against Native peoples left an indelible stain on the Nation’s honor. The xenophobic federal policies of forced assimilation authorized the government-sanctioned separation of Native children from their families where they were forbidden from speaking their language or practicing their religion.

The nonprofit International Life Science Institute claims to conduct “science for the public good” that “improves human health and well-being and safeguards the environment,” but really is a food industry lobby group, according to a study published today in the journal Globalization and Health.

The study provides examples of how ILSI advances the interests of the food industry, especially by promoting industry-friendly science and arguments to policymakers. The study is based on documents obtained via state freedom of information requests by U.S. Right to Know, a nonprofit investigative research group focused on the food industry.

The study’s authors conclude that, “ILSI should be regarded as a lobby group and that academics and researchers, policy makers, the media, and the public should view ILSI’s research as promoting the interests of the food, beverage, supplement and agrichemical industries” and that its actions “counter healthy public policies.”

“ILSI is Big Food’s global stealth network to defeat scientists, regulators and others who point out the health risks of their products,” said Gary Ruskin, co-director of U.S. Right to Know. “Big Food wants you to believe that ILSI works for your health, but really it defends food industry profits.”

The Globalization and Health paper was co-authored by Sarah Steele, senior research associate at Jesus College and the University of Cambridge; Gary Ruskin, co-director of U.S. Right to Know; Lejla Sarcevic, Intellectual Forum senior research associate at Jesus College, Cambridge; Martin McKee, professor at the London School of Hygiene & Tropical Medicine; and, David Stuckler, professor at Bocconi University.

In January, two papers by Harvard Professor Susan Greenhalgh, in the BMJ and the Journal of Public Health Policy, revealed ILSI’s powerful influence on the Chinese government regarding issues related to obesity.

ILSI is incorporated as a 501(c)(3) nonprofit organization, based in Washington DC.  It was founded in 1978 by Alex Malaspina, a former senior vice president of Coca-Cola. It has 17 branches located all over the world.

As an example of how ILSI keeps in close alignment with Coca-Cola and the soda industry, the paper quotes an email from Malaspina in which he laments ILSI Mexico’s failure to follow the industry position on soda taxes. Malaspina describes “the mess ILSI Mexico is in because they sponsored in September a sweeteners conference when the subject of soft drinks taxation was discussed. ILSI is now suspending ILSI Mexico, until they correct their ways. A real mess.”

“Our findings only continue to add to the evidence that this non-profit organisation has been used by its corporate backers for years to counter public health policies. We contend that the International Life Sciences Institute should be regarded as an industry group – a private body – and regulated as such, not as a body acting for the greater good,” said the study lead author Dr. Sarah Steele, a researcher at Cambridge’s Department of Politics and International Studies.

California Man Sentenced to 14 Years in Prison for Sexually Exploiting a Minor He Met While Playing “Clash Of Clans”

A Fresno, California, man was sentenced today to 14 years in prison followed by seven years of supervised release for using the internet to coerce and entice a minor into producing child pornography.

Assistant Attorney General Brian A. Benczkowski of the Justice Department’s Criminal Division, U.S. Attorney G. Zachary Terwilliger of the Eastern District of Virginia and Acting Assistant Director in Charge John P. Selleck of the FBI’s Washington Field Office made the announcement.

Emilio Morales, 29, was sentenced today before U.S. District Judge Liam O’Grady. According to admissions made in connection with his guilty plea, Morales met the 11-year-old victim while playing the online game “Clash of Clans.”  In 2017, Morales began grooming the victim over Clash of Clans before proposing that he and the victim communicate privately over the online chatting application Kik Messenger.  While communicating over Kik Messenger, Morales coerced and persuaded the victim to produce and send him sexually explicit images and videos.  The conduct ceased when, despite Morales’s attempts at manipulation, the minor victim refused to participate in any further sexual activity.

The case was investigated by the FBI Washington Field Office’s Child Exploitation and Human Trafficking Task Force and the Prince William County Police Department, with substantial assistance from the High Technology Investigative Unit of the Criminal Division’s Child Exploitation and Obscenity Section (CEOS).  The case was prosecuted by CEOS Trial Attorney Kyle P. Reynolds and Assistant U.S. Attorney Whitney D. Russell of the Eastern District of Virginia.

This case was brought as part of Project Safe Childhood, a nationwide initiative launched in May 2006 by the Department of Justice to combat the growing epidemic of child sexual exploitation and abuse. Led by U.S. Attorneys’ Offices and CEOS, Project Safe Childhood marshals federal, state and local resources to better locate, apprehend and prosecute individuals who exploit children via the Internet, as well as to identify and rescue victims. Grace for the Cure: Diabetes Alert Service Dog for Gracie Sevilla – www.GracieSevilla.com

In March 2018, our 4 year old daughter, Gracie Sevilla (now 5), was diagnosed with Type 1 Diabetes, an incurable, intense, auto-immune disease that inflicts mostly children in their grade school years; a disease whose cause is unknown and is not due to diet or family history, but rather genetic markers and environmental triggers which cause the Pancreas to no longer produce life saving Insulin (a hormone in the body) necessary for blood glucose production and functioning – both high and low levels of blood glucose cause diabetic ketoacidosis which leads to diabetic coma, swelling in the brain and then, death.

Our campaign goal for her is a Diabetes Alert Service Dog; a specially trained service animal that has the ability to quickly detect changes in her blood that could be life threatening. The dog then alerts the person with Diabetes and those around her, allowing time for treatment of both highs and lows.

We don’t currently have a dog and it makes perfect sense for our family pet to be specially trained to alert us of Gracie’s life-threatening highs and lows.

Kendall Simmons, an all-time Pittsburgh Steelers great, recently tweeted out to Gracie as being an inspiration to all with Type 1 Diabetes.

Gracie was also featured with her Ohio State Buckeyes Under Armour Flag Football League on Channel 2 & 9 news – Los Angeles – for not only being the youngest in the league, the only girl for that matter, but also the only Type 1 Diabetic in the league; wearing her Dexcom G6 under her shorts and on her thigh as she played.

Type 1 Diabetes, not to be confused with adult onset Type 2 Diabetes, requires moment by moment, day to day treatment and left untreated, can be immediately fatal. Persons with Type 1 Diabetes require Insulin injections after every meal; especially those which contain carbohydrates, as well as finger pricks to check blood glucose levels. Continuous Glucose Monitoring Devices (CGM’s) lessen the need for finger pricks.

Gracie receives multiple injections of Insulin daily after every meal and snack and one night time dose of a different type of Insulin (Lantus) which is long acting; periodic finger pricks and now wears a Dexcom G6 continuous glucose monitoring system that has a filament like catheter that inserts under the skin; continuously testing glucose levels and that which transmits a reading to our phones every 5 minutes and sounds alarms alerting us of dangerous highs and lows so that we may treat her high and low symptoms with Insulin or carbohydrate fluids or foods.

The Dexcom g6 is an absolute blessing for us and a literal life-saver. Gracie’s mother, Melodie, fought with her Pediatrician and our insurance company to get the “non-essential” medical device which even with insurance, is extremely expensive (each sensor cost several hundred dollars and needs to be switched out every 10 days or sooner and the transmitter or “brain” is 3 times as expensive and also last a relatively short period of time). These components often fail well before their expiration and long waits and troubleshooting sessions with tech support; fights with the pharmacies and insurance companies, much less the Pediatrician, are common.

DIABETIC ALERT DOG: Although the continuous glucose monitoring device (Dexcom G6) is essential to us (can’t imagine not having it after having had it), man-made technology fails and there is something much more reliable and would be such an amazing blessing to the entire family, especially little Gracie, who loves animals.

We don’t currently have a dog and a well-trained Diabetic Alert Dog makes all the sense in the world.

Properly trained, certified Diabetic Alert Dogs can alert of a life-threatening, impending high or low blood glucose level as much as 15 minutes sooner than a medical device and even a finger prick. God has designed these dogs with such an amazing keen seen of smell; instinct and loyalty for it’s owners that the dog will wake up or otherwise alert a sleeping parent or child to let them know that the blood glucose levels are rising dangerously fast or dropping dangerously low; such a loveable and reliable medical alert system to help strengthen what we already have and provide for just a little bit of peace of mind in the midst of what is a constant stressor and source of great anxiety.

Gracie’s dad is a great provider for his family but in considering this newly learned option (Diabetic Alert Dog); factoring in our family’s gifts and talents and our no choice other than to accept this disease and meet it head on, we’ve decided to take this route to help raise not only funds to purchase a specially trained dog from a reputable and certified Diabetic Alert Dog organization, but also to raise awareness about this horrible disease; something we are committed to doing for the rest of our lives.

Diabetes Alert Service Dogs from reputable, certified, licensed trainers cost in the tens of thousands of dollars and most insurance companies do not cover the costs of diabetic alert dogs or service dogs in general, because their effectiveness has not yet been proven in scientific studies. Therefore, for the reasons stated above and for this reason, we invite you to join little Gracie in our “Grace for the Cure” fundraiser for a Diabetic Alert Dog for Gracie, and to raise T1D (Type 1 Diabetes) awareness.

Until there is a cure for Type 1 Diabetes, there is Gracie, and if God wills, she shall have her furry companion soon enough while raising awareness, as we’ve learned so many no nothing, very little or are very misinformed about a very serious and life-threatening disease.

On Friday, April 12, 2019, the Riverside Under Armour – Under the Lights K-2 Flag Football Team – the Steelers (3-0), will be playing a double-header against the also undefeated Raiders, then against the 1-2 Rams. The game against the Raiders is a league showcase game  that pits two dynamic offenses and lock down defenses against one another for first place in the league and the inside track to play in the National Championship Game at UCLA in May.

The Riverside Steelers recently beat the Menifee Raiders by a score 20-8 with Riverside Quarterback, Luke Sevilla, recording an epic game with 3 interceptions at Safety; one was a pick 6.

Luke also was 5/6 passing with a touchdown pass and had many long gains at running back.

Guillermo Villarreal, had a strong game on defense with 6 stops.

Last week, the Steelers fell behind two (2) scores against the Riverside Seahawks, until Luke Sevilla, playing running back and safety, accounted for 3 touchdowns to bring the team to an 18-13 victory.

The Steelers team features 5 returning members from last years Championship game squad: Luke Sevilla, Gracie Sevilla, Jayden Sage, Guillermo Villarreal, & Noah Corona.

The Steelers have added 3 dynamic players to their mix this year: Sese Tuolioa, Eden Esau and Zane Sedoris – increasing their speed and skill exponentially.

Sese Tuolioa, is the 6 year-old brother of Lokeni and Leni Tuolioa; starting linebackers for the UCLA Bruins, and Lemusu Toailoa; starting Linebacker for the Sacramento State Hornets.

The UCLA tandem helped out at practice; bringing their friends and teammates, and were on the sidelines helping Head Coach, Tommy Sevilla at the Menifee showcase game.

Unique to the Riverside Under the Lights Flag Football League is Receiver, Running Back and Defensive End, Gracie Sevilla, the only girl in the league, the youngest player in the league (5) and a Type 1 Diabetic, recently diagnosed last year.

Type 1 Diabetes is an incurable auto-immune disease that affects mostly children from 4 years old and rarely strikes adults. Type 1 Diabetes is thought to be triggered by viruses/illnesses common to school aged children (RotoVirus, Foot and Mouth, etc) who have the genetic markers of Type 1 Diabetes, which causes the Pancreas to fight against its own beta cells and shut down partially, then entirely, rendering the Pancreas useless to produce life saving Insulin.

Gracie, literally needs Insulin Shots to stay alive and receives as many as 10 per day.

Gracie, whose blood glucose levels have dipped to deadly levels (32 mg/dl) or has risen to deadly levels (600 + mg/dl), plays with a continuous glucose monitoring device affixed to her thigh that sends a reading to her dad, mom and school teachers & nurses (River Springs Magnolia Center in Riverside) cell phone app, alerting them of both highs and lows.

The device is a Dexcom G6 and her father, Tommy Sevilla, the teams head coach of two years, keeps the receiver in his pocket as he coaches the kids; including Gracie, on the playing field.

Gracie was recently featured in Insulin Nation and on Channel 2 & 9 news – Los Angeles affiliates, regarding her Type 1 Diabetes and athletic prowess; Gracie also excels in Baseball, Soccer and Basketball. She currently stars for the Jurupa Valley Single A – Angels Baseball Team as an infielder and power hitter.

As a soccer player, Gracie was the leading scorer on her Riverside Parks & Recreation team and, as a Basketball Player, she recently made a long shot from the baseline area of the adult basketball court in a Parks & Recreation game at Reid Park.

Company Violated the Fair Credit Reporting Act and Consumer Financial Protection Act in Furnishing Consumer-Report Information and Obtaining and Using Consumer Reports

WASHINGTON, D.C. — The Bureau of Consumer Financial Protection (Bureau) today announced a settlement with State Farm Bank, FSB, a federal savings association headquartered in Bloomington, Ill.

As described in the consent order, the Bureau found that State Farm Bank violated the Fair Credit Reporting Act, Regulation V, and the Consumer Financial Protection Act of 2010 by obtaining consumer reports without a permissible purpose; furnishing to credit-reporting agencies (CRAs) information about consumers’ credit that the bank knew or had reasonable cause to believe was inaccurate; failing to promptly update or correct information furnished to CRAs; furnishing information to CRAs without providing notice that the information was disputed by the consumer; and failing to establish and implement reasonable written policies and procedures regarding the accuracy and integrity of information provided to CRAs.

Under the terms of the consent order, State Farm Bank must not violate the Fair Credit Reporting Act or Regulation V and must implement and maintain reasonable written policies, procedures, and processes to address the practices at issue in the consent order and prevent future violations.

Child with T1D Commits Whole Family to Care

The first months of new T1D care are scary, all-consuming and completely change family dynamics

Tommy and Melodie Sevilla share the story of their T1D daughter Gracie’s diagnosis, treatment, and achievement.

“Gracie’s leg hurt again.  It happened often. What could a little girl be doing to hurt her leg?  Then she was thirsty and listless. Finally, we looked up her symptoms on the web and took her to the pediatrician.  We felt so guilty when we confirmed that she had T1D. She had been suffering, and we didn’t understand.

Diagnosed with T1D in March 2018, Gracie was four-years-old, weighed 42 pounds, wore size 4 clothes and looked exhausted. Today, Gracie weighs 55 pounds, wears size 7, clothes, and stars in the Riverside/Corona Under Armour flag football league.

MelodieThose first days, I was scared.  I was in mourning for my child who was still alive, but I knew she would no longer have a normal life.  I feared that everything for her would be different and harder.

Learning how to care for her consumed us.  How to count carbs, measure her blood glucose, and give her injections.  It was like having a baby again. We were up at night checking frequently, living in fear, never quite sure we knew what to do.

TommyI didn’t know there were two types of diabetes.  I didn’t know about Type 1 Diabetes. I had only heard of Type 2 Diabetes.  I learned as much as I could as quickly as I could. I was ashamed to learn how little I knew and shocked at how many families were raising children with Type 1 Diabetes.

It took months to gain confidence in our ability to care for Gracie. Getting rid of soda was easy.  It was much harder to learn when to use fast acting versus slow acting insulin, or to judge the impact on her blood glucose of protein and exercise.

Normalcy is hard to come by.  Our marriage changed. Little things no longer mattered.  Dealing with the big thing required teamwork and support. Gracie’s T1D became a full-time job for the whole family.

TommyWe got a Dexcom G6 CGM for Gracie after five months.  It has been a tremendous help. Both Melodie and I have the Dexcom app on our phones.  I have the alarms set at 100 and 260 because I want some warning when I am coaching Gracie on her football team.  Melodie has her alarms set at 80 and 275.

We don’t plan to get a pump.  Kids can be cruel, and we don’t want Gracie to stand out too much from her friends.  She wears her Dexcom on her leg, so it is under her shorts. We plan to get an alert dog next.

MelodieGracie started Kindergarten this fall.  Picking a school for her was surprisingly hard.  Some schools did not comprehend the care a T1D child requires.  The school we chose had one staff member and the spouse of a staff member each with T1D. They have been amazing; caring and loving Gracie as their own.

I am careful about the carbs in Gracie’s school snacks — 3-5 carbs in her morning snack and 12-15 carbs in her afternoon snack at 1 PM.  Her snacks are only slow carbs such as jerky and nuts.

I prepare her school lunch, but I give her a lot of choice in what to eat because she gets Novolog with lunch.   I want her food to be normal kid-food, so she fits in with her friends.

TommyOn weekend game days, we also give her a 12-15 carb snack at 1 PM, so she is ready to play at 5 PM.  It is hot in Southern California, so she burns glucose quickly. If she gets low, we use Gatorade Chews or something similar. Gracie was the only girl and the youngest player in our Under Armour Flag Football League this Fall.  She was also the only child with T1D.

Now that Gracie is healthy again, she also excels at soccer, baseball and basketball, roller skating and singing Christian Worship Music. Phil Wickham is her favorite artist and “Amazing Grace” her favorite song by him; a song that causes me to cry every time I hear it.

MelodieI feel guilty about the impact Gracie’s T1D care has had on her brother and sister.  Too often, their lives and desires have taken a back seat due to Gracie having a hard night or something else.  Both are super serious about Gracie’s care. I think our whole family has become more serious as we each cope and help and work together.

I want our pediatrician, and all others across the country, to have a poster in her office about T1D symptoms.  No one should be as clueless as we were.

We are determined to raise awareness about T1D; particularly identifying the symptoms to prevent death and promote early diagnosis, and to share our experiences as persons living alongside T1D.”

Our team is participating in walks to end type 1 diabetes (T1D). The JDRF One Walk is one of many that we will participate in this year and we seek to also promote and support other reputable organizations, as well.

 

What’s in the World is Going On with Gracie?!

 

In March of 2018, our little Gracie was not her normal self. Her dad noticed her waking up several night in a row, late at night, to use the restroom and asking for something to drink as she was always “very thirsty”. Knowing a little something about Diabetes, her dad feared the worse and began to research and learn what he had been already fearing. He sent a link to his wife, who was fast asleep at the time and she was in denial. As the weekend approached, they knew they had to make an appointment with the doctor. Gracie’s Mom Melodie, was too distraught to call her Husband Tommy that morning, so one of his daughters had to, telling him to get down to the doctor’s office immediately, as it was certain Gracie was now a Type 1 Diabetic and they all needed to be trained to manage this deadly, life-long illness.

 

“It was not because of his sins or his parents’ sins,” Jesus answered. “This happened so the power of God could be seen in him.

So many questions were asked and so much was immediately learned; Type 1 Diabetes is not caused by eating too many sweets, a poor diet or being obese, but is rather an Autoimmune Disease whereby the Insulin producing pancreas shuts down for one reason or another, mostly likely the latent effects of having been afflicted with a virus long, or not long ago.

 

 

When you have T1D, your body stops producing insulin—a hormone essential to turning food into energy. Managing the disease is a constant struggle that involves monitoring your blood-sugar level, administering insulin, and carefully balancing these insulin doses with your eating and activity just to stay alive.

 

 

Gracie Sevilla – Type 1 Super Star!

We live by faith in Jesus Christ and lean not upon our own understanding, but rather trust Him in all things. Although sometimes it’s so much easier said then done, ultimately, we trust in Him and love Him so much. This being said, he’s blessed Gracie’s dad as a provider for his family and also with great determination and zeal for good things and causes; we feel ashamed at not knowing the struggles that so many dealt with before this came into our lives and we’re determined to overcome this daily with joy and live lives as normal as possible, using our talents and resources to the glory of God the Father; helping as many as possible and also helping to fund a cure.

Even with insurance this is an exceedingly expensive disease but where God guides, God provides and if we can bring awareness and also give to others in need like we have, awesome!

  • Attending special camps for Kids with Type 1 Diabetes, where the staff are either Type 1 themselves or highly trained and equipped. Gracie, only recently met another kid with Type 1 Diabetes in July; he, too, had a Dexcom g6 monitoring device, and it’s important for her to feel like she’s not alone, hence, our participation in these events organizing support teams and such;
  • 24 hour Glucose monitoring (Dexcom g6 sensors, for example, cost about $500 each and last only 10 days). Although we’ve been approved and have paid for a Dexcom g6 and have finally gotten insurance to cover it, there are always issues, limited supplies and red tape, forcing a lot of high, out of pocket expenditures;
  • Glucose Pump (something we are considering at the moment);
  • A specially trained Diabetic alert (service) dog that we are strongly considering at the moment. These dogs are specially trained and raised as pups in just a few places across the country and range from $10,000 and up. They can literally alert a glucose level drop or spike 15 minutes before it happens.

His latest creation, “Cigars Meet Movies” brought Marshall’s Campfire to the oldest movie studio in the world, Babelsberg Studio’s Theme Park in Potsdam Berlin, making it the world’s first cigar event in a major motion picture studios film park.

Inaugural Under Armour “Under the Lights” Friday Night Flag Football league Freshman Division Championship Game.

In it’s inaugural season, the Under Armour “Under the Lights” Freshman Division (K-2) is playing its Championship Game tomorrow night – Friday, October 19, 2018 – at 6:45 pm at Riverside, California’s Hillcrest High School.

Her father, Tommy Sevilla, is the team’s Head Coach and carries the device’s receiver; an iPhone 6 that is equipped with the app that gives a glucose reading every 5 minutes and has alarms to alert him when she is critically high or low. He must be within 10 yards of Gracie regularly in order for the device to continue reading.

Direct side effects of Type 1 Diabetes is stomach ache, pain in the extremities and head aches.

Gracie is the only girl in the league; the first in the Riverside/Corona league’s history and it’s lone Type 1 (T1d) athlete. Gracie chose football over being a cheerleader this year.

Armando “The Man” Muniz, is known in boxing circles as “The People’s Champ”, a sentiment widely shared as Armando, in 1975, traveled to Acapulco, Mexico to fight the legendary Welterweight Champion, Jose “Mantequilla” Napoles, and although battering Napoles the entire fight and the referee stopping the fight to spare Napoles further punishment, would raise Napoles’ hand in victory, after being called to the corner by WBC President, Jose Sulaiman, who ordered him to declare Napoles the victor, to the benefit of Napoles and the World Boxing Council. The disgraceful outcome would be known as the “greatest robbery in boxing history” and Muniz would be known thereafter as the “People’s Champ”.

Muniz, a member of the 1968 Olympic Boxing Team and NABF Welterweight Champion, would fight for the world title 4 times; his last fight was a loss to legend Sugar Ray Leonard.

Armando Muniz is one of the few professional boxers in history to also have earned a college degree. Armando is a graduate of UCLA and would later earn his teaching credential, finally retiring from teaching in the Jurupa Valley School District after many years of public service.

Nearly 15 years ago, Armando founded the Jurupa Valley Boxing Club in Rubidoux, California, to allow at-risk youth and community residents at-large, the opportunity to learn the art and skills of boxing.

Armando Muniz’ life after boxing included cameo roles in the hit ABC sitcom “Taxi” – role in the 1988 feature film “Midnight Run”, as well as spokesperson roles for Schlitz and Stroh’s Brewing Companies.

Born in Chihuahua, Mexico, Armando was raised in Montebello, California and attended it’s primary, elementary and junior high schools there, while earning a reputation as a world-class boxer and Olympic hopeful.

Tommy, recalling the good times of the 1980’s Reggae Scene and his passion for Reggae Music:

“I have fond memories of my youth as a fan of Reggae Music and being a part of Los Angeles Reggae Music history, especially.

I was there at Bunny Wailer’s first state-side appearance in Long Beach, back in the 80’s.

I remember vividly, the historic Fela Anikulapo Kuti concert at the Olympic Auditorium where, me and champion bubbler, Clinton Dove, watching Fela, with his massive horn section, 2 drummers, and huge harmony vocals secition (all of his many wives), skanked alongside young members of the Red Hot Chili Peppers, also there as young fans.

Alpha Blondy’s first show in L.A. was also monumental and historic.

The late Milt Wilson, truly produced the best shows at that time; the Music Machine was legendary, even a place where I, all but 17 or so and not even allowed in, stepped on Mutabaruka’s barefoot and evoked a “Raaas Claaat” like I never heard before. I would later promote a few shows and spoken word readings with him and his incredible band, at the Palace, Coach House and System M Art Gallery in Long Beach.

Perhaps the greatest musical experience I ever had though was a show that me, Ital Jim and Sean produced with the unique Strictly Roots of Northern California at Claremont Mc Kenna College (Jim and Sean were students there and Jim hosted the “Dread Riddims” Reggae Show on 88.7 KSPC) where, it was like Reggae meets the Allman Brothers and every song was a 12 minute, psychedelic lead guitar solo. It was pitch dark, the Sensimilla was bomb, and the girls nice!

I will never forget interviewing Rita Marley and her kids, along with mother Cedella, at the Bob Marley Day Festival, and later in years, smoking a huge spliff with Aston “Family Man Barrett” and the rest of the Wailers, at the Country Club in Reseda.

Licking a 5′ tall, saxophone like chalice, packed with ice and Lambsbread Collie from the Blue Mountains of Jamaica, with Ras Michael, the late Derrick “Debo” Brown, Clive Ross, Zacky and others, was unforgettable, as I was promoting the great Leroy Sibbles that night, backed by Jamaica Inc, at the iconic and legendary Kingston 12 in Santa Monica. This was before the show started and factor in the Guinness; I was in full mediation mode.

Especially cool was being backstage at the Greek for the 2 night Steel Pulse and Jimmy Cliff shows, when I see Earl “Flabba” Holt (Roots Radics) standing outside, unable to get in, as his name was left of the guest list by mistake. I was able to convince security to allow him in and ironically enough, had an almost identical experience with Judy Mowatt and her entire entourage at the Universal Amphitheatre for UB40 where, Me and Clinton Dove, literally watched the show from in and out of the aisle, giving up our seats for Judy and her posse, repeatedly being warned and pushed back into the seats the entire night.

Linton Kwesi Johnson at the Conga Room, was also a one of a kind experience. Dennis Bovell and his Dub Band, along with Sly & Robbie’s Taxi, Sounds of Resistance, Mad Professor Posse – bar none – greatest bands of the area and of all-time, skill-wise and precision.

Members of UB40 (immediately after their show at the Greek), among others like Joe Higgs and Garth Dennis (Black Uhuru and Wailing Souls), would be guests of ours backstage at the Whiskey for our sold-out shows with Eek-a-Mouse, Rankin’ Scroo & Ginger and Ridim Section (another phenomenal band!).

Me, Sean and Jim promoted the “King and I” Tour for Mouse in 1987.

One time me and Clinton Dive hosted H.R. from Bad Brains at our apartment on Holt Blvd. in Pomona, California, for several weeks. A truly different cat, I still don’t know how or why he was with us (laughing), but he was with us all that time – on our dime – and barely spoke a word!

I was momentarily revered by my Chino High School punk rock friends dueing that time, like my buddy Pat Ellis and straight edge pioneers, Justice League.

Driving home an angry (not at me but Clinton) Mikey Dread, was also memorable (laughing), and scrapping with Prince Ital Joe, backstage at the Coach House; being followed on the 5 North, with a 357 pointed at us, is not something me and my bredren Clinton particularly enjoyed in our Reggae history (laughing).

On that note, there was also the time when Ginger, Rankin’ Scroo’s beautiful and talented wife, literally saved my life on tour with Eek-a-Mouse, in Santa Barbara.

How can I ever forget spending time at Roger Steffens’ house for interview with the great Dub Poetess, Lillian Allen, marveling at Roger’s immense Reggae Music Archives.

Me and Tony Montgomery (keyboardist) of Bass Culture, are still recovering from our sensi session with Eek-a-Mouse at the motel I put him up at in Pomona. A few warm Guinness and some Humboldt County one-of-a-kind, had us in a nice place, with air conditioning inside and 100 + degree heat outside. We were literally blinded by the light upon exit.

To this day, Mouse still owes me $100 and my cordless Cobra handheld phone! (laughing)

I’d be remiss without saying that, I owe all these fond memories to my uncle Donny, who introduced me to Reggae Music, at about age 12, and longtime friend Tony Montgomery of Bass Culture, who took me to my first Reggae show in Santa Monica, where the Meditations, headlined.

Getting into the business and doing some pretty cool things at a young age and until I was about 20 years old, was due to the mentoring and guidance of Rita “Miss Wire Waist” Harrison (Smoothie Jones’ Auntie) of KPFK – “Sounds of Jamaica” fame; a place where Tony, Fred, Donny, Dan and Pablo of Bass Culture, played live, and where we happened to meet the young, rambunctious youngster – a few years older than me – Trevy Felix of Boom Shaka, who we always admired and knew would mash it up.

Miss that guy.

Wire Waist, Stamma Haughton, Joe Higgs, Leroy Sibbles and Stranger Cole, were some of my absolute favorite people in an out of the industry. Just a youth, they mentored and guided, as opposed to exploited.

Being a booking agent or band manager was rough in those days; no cell phones, the Apple Mac had just come out, no faxing just yet. Advertising in the L.A.Times Calendar or L.A. Weekly was for the most part, out of reach. A lot of flyers and posters, free calendar listings, word of mouth and college radio.

I remember walking to the pay phone on 3rd Street in La Verne to call Jamaica, Birmingham England, New York, Toronto Canada, and other parts of the world, to do my business, with a pocket full of dimes, after running up thousand dollar phone bills at my Grandma’s house!

Cathy Bishop Fragoso, a Riverside County Social worker/Supervisor (DPSS) for more than 20 years – a mother, grandmother and widow – suffered catastrophic injuries when illiegal street racers, in 2 separate vehicles, slammed into the vehicle she was a back passenger in, with one car fleeing the scene.

Subsequently, Cathy suffered traumatic brain jury, a broken neck, broken arm, broken pelvis, broken leg, ruptured and lacerated organs, injuries to her eyes and multiple strokes.

Cathy, a career Department of Social Services Supervisor for Riverside County, is no longer able to work and has incurred nearly 2 million dollars in medical bills thus far, and will need medical care for the rest of her life.

NO ARRESTS have been made, despite San Bernardino Police Department knowing the identity of the drivers who did this to her and her two close friends; also injured. San Bernardino Police Detective – Peck, a former “street racer” himself, has been indifferent toward the plight of the victims yet, sympathetic to the offenders.

LOMA LINDA (CBSLA.com) — A Riverside grandmother was in critical condition Monday night after an accident Saturday evening that’s being blamed on illegal street racing.

As KCAL9/CBS2’s Tina Patel reports, the 62-year-old woman, Cathy Fragoso, was in the backseat of a car coming off the 215 Freeway in San Bernardino when they were hit by two cars that appeared to be street racing.

Fragoso is now in the hospital with traumatic brain injury, a broken neck and severe internal damage.

“They’ve said she may never walk again. Might not talk. She’s never going to be the same,” said daughter Melodie Sevilla.

“From what I understand the first car clipped the back of the car. The car spun and then the second car hit and it caused it to roll a few times,” Sevilla said.

Police told Sevilla they are still looking for the first car which took off after the accident. The driver and passenger in the second car were injured themselves but Sevilla said police still haven’t told her family who they are or if they are facing any charges.

“They did go to the hospital. We know that. But from what we understand they were released from the hospital,” said Sevilla.

Sevilla and her family said they’re just trying to focus on her mom’s recovery right now. But they do want drivers who race to know just how devastating their actions can be.

“It’s just needless, just needless,” said Sevilla. “It didn’t have to happen.”

Why do people believe that FRESNO POLICE CHIEF JERRY DYER MURDERED Fresno POLICE Lieutenant, JOSE MORALEZ?

Fresno Police Lieutenant, Jose Moralez, told his department appointed psychologist – the day he was found dead across the street from Fresno Police Jerry Dyer’s home – that he was going to “confront” Jerry (a physical confrontation was understood), the day that Jerry Dyer had Captain Al Maroney fire him.

Fresno Police Lieutenant, Jose Moralez, did not go to Chief Dyer’s home, in rural South Fresno, to simply stand outside his Chevy Truck and commit suicide, as the Fresno County Sheriff and Coroner would have the public believe.

Evidence of a Cover Up – Fresno City Personnel – Fresno Law Enforcement and County of Fresno personnel Have Come Forward

Law enforcement eyewitnesses and other official Fresno city and county personnel have come forward to say that they were at Jerry Dyer’s home and saw Chief Dyer – covered in Jose Moralez’s blood, in a state of shock – being asked by – based upon information and belief, a Fresno Sheriff Lieutenant – if Lt. Jose Moralez’s death was “self-defense”, and to which Chief Jerry Dyer did not respond – twice.

This law enforcement officer then reportedly stated,

“Chief, this does not look good for you, we (Fresno County Sheriff) will take care of it.”

Based upon information and belief, the cover up of Jose Moralez’s murder by then and current Fresno Police Chief, Jerry Dyer, at that time – was born.

Fresno Police Chief Jerry Dyer Protected by former Fresno County Sheriff Pierce?

Based upon information and belief, after Jerry Dyer shot Jose Moralez point blank in the chest – Jose Moralez’s body was moved across the street and placed at the side of the adjacent road, near his truck; his dead body and scene made to look like a “suicide”, as all official reports would later declare.

The Fresno County Coroner – based upon information and belief – is also said to have taken part in this felonious and cruel conspiracy.

Corroborating Evidence & the Intentional Omission of Facts

It is a FACT that Jose ( “Joe” ) had a gash above his eye, indicating a physical altercation with DYER, who he went to visit the night of his death. He did not have this gash when he left the police department after being fired, for Jerry that day, by then Captain, Al Maroney, nor did he have it when he met with his department appointed psychologist. He certainly did not have it when he left his son Dustin, and daughter Kaelyn, at his southeast Fresno home – urgently and visibly troubled – after receiving a mysterious phone call. His teenage children would never see him alive again.

After telling his department appointed psychologist that he was going to “confront” Chief Dyer about his unjust firing and – based upon information and belief, threaten to expose Jerry for his corruption and felonious behavior – Jose would telephone his wife, Yolanda Moralez (a recently retired Fresno Police Detective) after leaving his son and daughter at home, saying to her,

“Babe, does Jerry live on American?”

The question to Yolanda was rhetorical, as Joe (Jose) knew exactly where Jerry lived; having been there several times before. No doubt, Jose was leaving his detective wife a very important clue, as he knew things could end badly for him.

Fresno Police Lieutenant Jose Moralez Was

“… NOT Suicidal.”

It is a fact that Jose’s department appointed psychologist met with Jose the morning of the day of his death – at Jose’s urging – to which his psychologist would later vehemently say that Jose was “not suicidal”, but rather incensed at Chief Dyer, and was planning to have it out with him – physically.

Is Chief Dyer Being Slandered or Defamed Here?

Why would sworn Fresno Law enforcement and city personnel say that Joe’s (Jose) body was in Jerry’s lawn – surrounded by Fresno Police Officers when the official story was that he was “found dead” , with a “self-inflicted gunshot wound to the chest”, 100 feet away from Jerry’s house, on the side of the road, outside of his truck, laying face down, with a gun at his left side (Joe was right-handed)?!

(This sharply contradicts what the Fresno County Sheriff has tried to perpetrate to public since 2004 and it goes without saying that Federal investigation is warranted.)

To further cloud the issue and make the official Fresno County Sheriff version even more unbelievable, it was an anonymous motorist from Los Angeles, who allegedly found him – in the dark of the night in a rural area – there, calling 911 and reporting these circumstances in fine detail as if they knew the area very well. They quickly and clearly described a “man” laying dead near a perfectly described “Chevy” truck.

Why was this anonymous person, supposedly from “L.A.”, on [then] dead-end Sunnyside Rd., where there are no lights, on a cold winter night?!

(Chief Dyer’s home, at the time of the incident, is 3rd from the left. Lieutenant Jose Moralez’s body was allegedly discovered by the anonymous motorist further back then where the red car is.)

How much more unbelievable is the Sheriff Department’s story when this caller was never identified – never interviewed and this persons cell phone service was immediately turned off after the mysterious call.

Jerry Dyer’s neighbors were NOT interviewed by the Fresno County Sheriff investigator in his bogus investigation; a fact later corroborated by the neighbors themselves when later interviewed by Jose’s widow, Yolanda Moralez.

Interesting also how nobody, not even Chief Jerry Dyer or his family, even heard a gunshot from a few feet away, in the dead of a cold winter night, when sounds are heard more clearly.

What is ultra incriminating against the Fresno County Sheriff and Coroner, entirely absent in their reports is the FACT that …

Dead Men Don’t Make Phone Calls?

Lt. Jose Moralez, made phone calls from his personal cell phone at the time he would’ve been dead, according to the Coroner and Sheriff’s Department! He called his voicemail at a time that would’ve been absolutely impossible!

What About the Gun?

What about Jose Moralez’s personal .40 Caliber Glock handgun, that he was alleged to have killed himself with? It was given back to his widow and in all Fresno County Sheriff department Police Reports, is identified by serial number but, when the gun was ran by CHP in a vehicle stop a few years later, that gun came back to the officer as NO RECORDS FOUND; not registered to Fresno Police Lieutenant, Jose Moralez.

How can that be?!

Federal Crimes Committed by the Fresno Police Department – Fresno County Sheriff and Fresno County Coroner

 

Not only did the forgoing events take place and were not documented by the Sheriff’s Department, but Jose’s personal locker at the Fresno Police Department was broken into by Police personnel (had to be right?) and items stolen. His Skelly Hearing paperwork was in there among other things (gun)?

Additionally, as the mortuary called his widow, okaying her to come pick up his personal belongings – “cops” got there before she did and took the belongings – under the guise of official business – Why?

Bogus Autopsy and Coroner’s Investigation Squarely Focused on Suicide

Jose Moralez was NOT wearing the clothing he was described to have been wearing in the official autopsy report which, by the way, neglected to document the following routine examinations and tests, among other facts:

  • A Liver Temperature Test was not performed; this is necessary to determine the time of death;
  • A Gun Shot Residue (GSR) Test was NOT performed; this is necessary to rule out suicide or murder. CORRECTED on 11/2/17: According to official Fresno County Coroner Autopsy Reports – GSR tests WERE PERFORMED ON JOSE MORALEZ and NO GUN SHOT RESIDUE WAS FOUND!!!
  • The time of Jose’s alleged “suicide” and the time at which rigor mortis is claimed to have set in cannot be true, given the fact that Jose made phone calls just before midnight;
  • Jose was documented in the autopsy as being “circumcised” when he was not;
  • Times were changed on no less than 3 different pages of the report and Sheriff personnel would admit to reports being order to be changed.

This information, as well as the gathering at Jerry’s home and before the “command center” was created, is entirely absent in all official police and Coroner’s reports relating to Jose’s death!

Jerry Dyer’s False Alibi – Where was Jerry?

 

Fresno Police Chief Jerry Dyer, would claim to have been at a local restaurant the night of Jose Moralez’s death until 9:00 pm or so and then came home but, the local restaurant owner and employees could not corroborate his alibi of having been there. They said he wasn’t!

In early August, a Fresno County Sheriff Sergeant, who was a deputy and one of the first responders the night of Jose death (so he claims in that fashion), would reveal by his statement to this writer and to Jose’s family that, Chief Jerry Dyer was NOT at home as he claimed in official reports but rather “…drove up” to the “suicide” scene, which was well after midnight, after having left his “office”, presumably.

This, now Sergeant, tripped up and effectively threw Chief Dyer under the bus, exposing him by corroborating the fact that Chief Jerry Dyer was in fact NOT inside his home innocently, when Jose allegedly fired the lone shot into his chest from across the street, as Chief Jerry Dyer himself, claimed.

Clearly, based upon information and belief, Jerry Dyer, as part of the charade, must’ve driven his car across the street, for this deputy (now Sergeant) to have truthfully witnessed what he claimed to have!

Where was Dyer, at home?

Asleep with his family, never hearing a gunshot?

Or, was he in the front lawn covered in Jose’s blood, only to later make it seem as though he “drove up” to which this now Sergeant would claim to say to him, “Hi Chief”?!

 

CORRECTED: The investigation was NOT conducted by current Fresno County Sheriff, Margaret Mims, as previously written here, but at the time of Joe’s death, Margaret Mims was with the department and based upon information and belief, is well aware of the competing circumstances.

Professional and Personal Blackmail Against Chief Jerry Dyer?

Based upon information and belief, IT IS A WELL KNOWN FACT OR PERSONALLY HELD BELIEF WITHIN THE FRESNO POLICE DEPARTMENT AND SHERIFF’S DEPARTMENT THAT LT. JOSE MORALEZ DID NOT COMMIT SUICIDE and not just a personally held belief or popular conspiracy theory in fact, it is said to be well-known that…

Fresno County Sheriff, Margaret Mims, is in possession of, and has been in possession of documents/a letter that directly implicates Chief Jerry Dyer in Jose Moralez’s murder, and has used it against Chief Dyer for political “blackmail” purposes, such as when Jerry had ambitions of “running for Sheriff” or “consolidating the two departments”, basically, “to keep him in check”, as according to sources, Mims cannot stand Jerry Dyer and even once threw him out of her office.

 

 

 

Investigation Conducted by an Ex-Fresno Sheriff Deputy

Yolanda Moralez, Jose’s Widow, as previously mentioned, was herself a barely retired Fresno Police Detective whose stellar career was featured in a book about Hispanic women who have broken the glass ceiling entitled, ‘Mariposa’. Yolanda worked homicide and Major Drug Buys, along with CCAT and VCSU; she knew Jerry Dyer well and emphatically believes/knows that Jerry Dyer murdered her husband, Lt. Jose Moralez, and a cover up by the Fresno County Sheriff and Coroner’s Office – ensued.

Not only did Yolanda conduct her own investigation into this matter, but a former Fresno County Sheriff Investigator/Deputy – now a highly regarded and successful Private Investigator, did as well, and the findings are astonishing, revealing that Fresno Police Lieutenant Jose Moralez could not have committed suicide as claimed by the Fresno County Sheriff, Coroner and Police Department, and that the Sheriff’s & Coroner’s Office investigation is flawed to the point of utter corruption.

A matter of public record and accessible under the Freedom of Information Act – why did the CITY OF FRESNO fight to conceal the phone records of Joe’s department issued cell phone?

Their claim was that releasing the phone records to Yolanda Moralez, Joe’s widow, would pose a security concern, as she would then have access to the Fresno P..D. personal cell phone and home numbers yet, Yolanda Moralez was the recently retired Detective Yolanda Moralez of Fresno Police Department and already had the phone numbers of the entire Fresno Police Department, which is not unusual as department personnel are given Call Out Sheets for this very purpose, to have the phone numbers of departmental personnel for contact purposes.

Why did Yolanda Moralez’ attorney, KEVIN LITTLE, fail to amend the complaint and fail to show up in Court, causing Yolanda Moralez’ lawsuit to be dismissed with prejudice?!

Based upon information and belief…INTIMIDATION.

Mrs. Moralez didn’t even find out about the dismissal of her lawsuit until a hearing had been conducted and the City of Fresno’s Motion for Dismissal was granted by Judge Ishii; she found out by receiving a letter from the Court in the mail, not even from her incompetent and corrupt attorney, who should be disbarred for his actions. The Relationship Between Jerry Dyer and Jose Moralez

 

Chief Dyer illegally terminated his long-time friend and loyal Fresno Police Department Lieutenant, Jose Moralez on the very day of his subsequent death. Despite Jose having an exemplary career with the department for more than 30 years and set to be one of its next Captain’s, he was the subject of an Internal Affairs Investigation surrounding an extra marital affair; the stated cause of his termination was an email he sent to a female departmental employee.

 

 

 

 

It is well-known within the department and in Fresno that Jerry Dyer himself has had extra marital affairs, illegal steroid use, numerous physical confrontations, public and private drunkenness, and even his admitted sexual relations with an underage teen girl which amounts to child molestation or statutory rape, and to which Jerry would ADMIT TO recently (to Yolanda Moralez and her children), in no way denying it (he has publicly skirted the issue but has not denied it). Yet, the good ol’ white boy that Jerry was and is, earned him protection from his then Chief and cohorts and despite all of his unworthy behavior, that should’ve resulted in termination and would’ve for a minority – no doubt; rose to become Fresno’s current Chief of Police, even as based upon information and belief, he is officially retired and on contract, reaping a whirlwind of benefits and money, said to be at about “a million dollars” annually.

I know first hand that Jose Moralez was not a kiss ass and not part of Jerry’s copulating crew of suck ups; he was genuinely hurt and in fact, enraged by Jerry’s hypocritical treatment of him and felt betrayed after being loyal to him all those years. Jerry bought a home directly across the street from Jose – they were that close. Joe was determined to pull Jerry’s covers if he fired him for doing far less than what Jerry, himself, had done and continued to do. He personally told this me.

Suicide? Joe was never depressed a day in his life. Never.

Joe had repented from his adulteries and was exceedingly remorseful, fearful that he’d lose his beautiful family; his wife Yolanda forgave him and they were happy and on the road to healing. The Glaring Inconsistencies and Impossibilities

There was not and there continues NOT to be a legitimate and unbiased investigation into Lieutenant Jose Moralez’s death. It was done purely from the standpoint of suicide with all other facts ignored and – based upon information and belief – with the intent to protect Chief Dyer from possible criminal prosecution for murder or manslaughter.

  • What’s to be revealed in Jose Moralez’ cell phone records?
  • Why would the City of Fresno fight Jose’s widow in court to hide Jose’s last phone calls?
  • Who were they to?
  • What about the gun that Jose allegedly used to take his own life – there are glaring inconsistencies with that ultra-relevant detail?
  • THERE WAS NO GUN SHOT RESIDUE ON JOSE MORALEZ according to Coroner’s Reports – this is IMPOSSIBLE if he shot himself!!!
  • Why wasn’t a liver temperature test taken; this would’ve been done even with a John Doe transient found dead on the side of the road?
  • The Autopsy Report is seriously flawed and hardly thorough, as dates were changed and are inaccurate. Moreover, the claim of when rigor mortis set in is huge in the Coroner’s Report, as scientifically, it is impossible.
  • Why the gash above Joe’s eye? He didn’t have it when he left his home, and why isn’t the length and description of it specific, as it should be?
  • Jose Moralez told his department appointed psychologist that he was going to “confront” Jerry that day; he did not simply park a few yards from Jerry Dyer’s home to commit “suicide”!
  • If “suicide” and Joe being right-handed – why the gun on his left side, his body face down?
  • Who commits “suicide” by shooting themselves in the chest?

Why was the 911 callers phone immediately disconnected, and why was that person never identified nor interviewed?

Based upon information and belief, Jose Moralez was murdered and all evidence points to Jerry Dyer, or one of his trusted officers (One of Jerry’s closest Captain’s is also suspected to be directly involved).

A Request for Investigation and Indictment by the Fresno County Grand Jury was made but it (the Fresno County Grand Jury) was then disbanded.

The civil lawsuit filed against the City of Fresno on behalf of Joe’s widow and children, was dismissed due to, based upon information and belief, the intentional sabotaging by his widow’s own attorney via pressure from the Fresno elite. (In fact, this attorney now acts as if he doesn’t even know his former client in what was a very high-profile case!)

Clearly, justice in the civil federal court was never given a chance to succeed, due to the legal obstruction by the City of Fresno and an exceedingly incompetent or malicious attorney.

The City of Fresno, the County of Fresno and the State of California have looked the other way; is Jerry Dyer that powerful and revered, and Jose Moralez’ life and family that worthless? Does justice only belong to the elite and powerful?
